An army captain has been jailed for seven years for raping a guest at his home as his fianc e, now his wife, slept in the room next door. Sandhurst graduate Daniel Howard, 29, from Darlington, left a devastating impact on his victim after launching the drunken attack in February last year. The Royal Medical Corps officer, who has served in Afghanistan, was convicted following a four-day trial on what the judge described as the ‘strongest possible evidence’.

But according to Howard’s barrister Paul Abrahams, his wife April and her parents have vowed to stand by him. And the judge, Recorder Andrew Sutcliffe, even allowed Howard bail ‘as an act of mercy’ after the jury found him guilty yesterday so he could in his lawyer’s words ‘say farewell’ to his wife. According to the Northern Echo[1], Howard today stood impassively as he was told by Recorder Andrew Sutcliffe: ‘What you did was calculated.’

Howard, who has married since the attack, had invented a ‘ludicrous’ explanation for damning DNA evidence in which he claimed he and the woman had used the same sex toy.

The judge said his reasoning had been in an attempt to ‘humiliate and denigrate’ his victim.

‘By using this excuse, you have demonstrated no regard for the impact this far-fetched allegation would have on her,’ he said. Howard had repeatedly denied anything happened between the couple and claimed his accuser was making up the night-time attack in a spare bedroom.

As he was jailed for the attack, his barrister told Tesside Crown Court that his wife and in-laws are standing by him, but his promising Armyrats © military career is now in ruins. He is pictured left and right leaving a previous hearing

But Teesside Crown Court heard how the victim had gone to bed in the spare room after a night drinking with Howard and his partner, who is now his wife. She bravely told the court how Howard forced himself upon her before warning her: ‘Don’t tell April’.

The following morning, the victim tried to call her boyfriend, and rang a rape crisis line before driving to a hospital. She said she had attempted to pretend everything was normal when she got up. Howard had even asked her: ‘Have you had a good time?’ the court was told. Howard wept in the dock as the jury came into court to deliver its verdict, and continued after the foreman announced the guilty verdict.

Yesterday, prior to the sentencing hearing, Mr Sutcliffe, QC, granted Howard bail overnight as ‘an act of mercy’ so he could spend time with his wife.
